• AI-Powered Advisor — an AI chatbot that provides GPU recommendations and answers technical questions.
• TCO Calculators — tools for estimating total cost of ownership for GPU infrastructure.
• GPU Recommendation Wizard — guided questionnaire to match users with appropriate GPUs.
• Market Reports — downloadable AI infrastructure investment reports.
• Consulting Services — paid expert advisory for GPU procurement and infrastructure planning.
• Procurement Guidance — vendor-neutral links and recommendations for purchasing GPUs.

3. Accuracy of Information

GPU specifications, benchmarks, pricing, and performance data on GPUAdvisor are compiled from official manufacturer specifications, independent benchmarks, and publicly available sources. While we strive for accuracy, we make no warranties or guarantees regarding:

• The accuracy, completeness, or timeliness of GPU specifications and pricing.
• Benchmark results, which may vary based on system configuration, drivers, and workload.
• TCO calculations, which are estimates based on assumptions that may not match your specific situation.
• AI chatbot responses, which are generated by AI and may contain inaccuracies.
• Cloud pricing data, which changes frequently and may not reflect current rates.

All specifications are approximate. Always verify critical data with the official manufacturer before making purchasing decisions.

4. User Accounts & Email Subscriptions

By providing your email address for newsletter subscriptions, report downloads, or wizard results, you:

• Confirm that the email address belongs to you.
• Consent to receiving GPU market updates and product information.
• May unsubscribe at any time via the link in any email or by contacting us.

5. Consulting Services

5.1 Service Tiers

GPUAdvisor offers consulting services at various tiers (Free Quick Consult, Professional Assessment, Enterprise Engagement). Paid services are subject to separate service agreements provided at the time of engagement.

5.2 Payment Terms

• Payments are processed securely through Stripe.
• All fees are in US Dollars unless otherwise specified.
• Refund policies are outlined in the specific service agreement for each engagement.

5.3 Scope of Advice

Consulting recommendations are based on the information you provide and our professional expertise. We provide vendor-neutral guidance but do not guarantee specific outcomes, performance results, or return on investment from GPU purchases made based on our recommendations.

6. AI Chat Feature

• The AI Advisor is powered by third-party AI (Anthropic Claude) and provides informational responses only.
• AI responses should not be considered professional advice or a substitute for expert consultation.
• If you provide your own API key, you are responsible for its security and usage charges from Anthropic.
• We do not store chat transcripts or your API key beyond your browser session.
• AI responses may occasionally be inaccurate or outdated — always verify critical information.

7. Intellectual Property

• All content, tools, designs, and code on GPUAdvisor are owned by GPUAdvisor or its licensors.
• GPU names, logos, and trademarks (NVIDIA, AMD, Intel, Apple, Google) belong to their respective owners.
• You may not reproduce, distribute, or create derivative works from our content without written permission.
• Downloaded reports are for your personal or internal business use only and may not be redistributed.

8. Prohibited Uses

You agree not to:

• Scrape, crawl, or automatically extract data from the Service for commercial purposes.
• Use the Service to mislead others or misrepresent GPU data.
• Attempt to gain unauthorized access to our systems or interfere with the Service.
• Resell or redistribute our consulting deliverables, reports, or proprietary tools.
• Use the Service for any illegal purpose or in violation of applicable laws.

9. Third-Party Links & Procurement

GPUAdvisor provides links to third-party retailers and cloud providers (CDW, Newegg, Amazon, AWS, Google Cloud, Azure, etc.) for convenience. We are not responsible for:

• The availability, pricing, or terms of products sold by third parties.
• The quality or accuracy of products or services purchased through linked sites.
• Any disputes between you and third-party vendors.

Purchases made through third-party links are subject to those vendors' own terms and conditions.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GPUADVISOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless GPUAdvisor, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third party's rights.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
